The state filed no formal charges against Roman Rodriguez, freshman exercise science major, Jan. 16 because the investigation is ongoing, Vanderburgh County Prosecutor Malcom Gwinn said.
Rodriguez was arrested after a female USI student accused him of raping her following a party they both attended on USI’s campus Jan. 14.
The alleged rape occurred in a residence hall between 2:30 and 4:30 a.m.
It’s still possible Rodriguez could face charges, Gwinn said.
A no contact order is in place at the request of the alleged victim with a hearing set for Feb. 7, Gwinn said.
Dean of Students Barry Schonberger said the student conduct process is separate from the criminal process, meaning Rodriguez could face trouble for violating the university code, too.
If the university determines a student is threat to themselves or others, they can be removed from student housing.
“The university investigates occurrences to ensure the safety of the community,” Schonberger said.
Rodriguez could not be reached for comment, and Rodriguez’ attorney Terry White declined to comment.
